Davis’s statements are inconsistent about flipping the bird as he passed Vilchez. Statements from Davis’s daughters suggest a history of Davis demonstrating aggressive behavior when he encounters a driver that is slower then him, when his children are present in the car.

 

 

 On Page 9 he did not gesture at all, but on Page 11 he did flip Vilchez the bird. Davis’s girls even remember their dad flipping the bird. Davis daughter Lakala stated that Louis Davis gets mad at drivers and will make the statements “They’re going to slow or something” or “Go ahead”. These statements show Louis Davis has demonstrated a history of impatient, bird-flipping, aggressive driving with his daughters in the car when someone is driving slower ahead of him. Louis Davis’s youngest daughter Lakyah Davis (7 years old) already knows when dad is flicking somebody the middle finger in traffic; she was 6 at the time of the incident.
